This will serve as formal notice to you that ALPHA PUP RECORDS (the "Company") is an owner of sound recordings embodied in the album entitled "REEFER" (the "Album") performed by REEFER. The ownership of these sound recordings and the copyright in them give the Company the right to control their commercial and non-commercial exploitation worldwide.
You are now engaged in the unlawful distribution of sound recordings from the Album. No written authorization has been obtained by you from any person on behalf of the Company in connection with these sound recordings. Your actions described above infringe the Company's rights in numerous ways, including but not limited to copyright infringement in violation of the federal Copyright Act, USC 501 et seq, and could be liable for statutory damages as high as $100,000. Further, such copyright infringement is a direct violation of the Digital Millennium Copyright Act.
We hereby demand that you do the following:
(1) Immediately remove the link to Sharebee.com;
(2) Agree in writing that you will engage in no further activities concerning this Album; and
(3) Immediately destroy all copies of the Album that are currently in your possession, custody or control concerning the sound recordings and related artwork.
Please be advised that if you do not do all the foregoing within the time stated above, and in no event later than ten (10) days from the date of this letter, the Company will pursue all legal rights and remedies in connection with this matter.
Nothing contained in this letter constitutes an expressed or implied waiver of any rights, remedies or defenses of the Company, all of which are expressly reserved.
